 Dear Sir/Madam,

Reference:  False Claims of Physical Abuse of an Acer Laptop Purchased from the Good Guys at Nunawading Victoria

On the 1st of November 2009 my wife and I purchased an Acer laptop from the above store. The cost of the laptop was $769.00. Please find attached the Receipt/Tax Invoice from the sale. You can’t miss it; it’s titled Receipt/Tax Invoice.

Approximately 4 weeks later there was a screen fault with the machine. I subsequently took it back to the place of purchase and asked that it be fixed under warranty. I foolishly believed that corporations like Acer actually honoured their warranty agreements. The Good Guys at Nunawading looked at my broken laptop. They knew it was a laptop as I told them. They poked at the laptop, prodded at the laptop, turn it around and upside down, they even sang nice songs to my laptop, but alas it would not work.

The staff at the Good Guys Nunawading in their own little technical prowess kind of way assessed that the laptop had a screen fault and sent if off to Acer for repair. I know that was their diagnosis as they wrote that on the Repair Order Document. Screen fault. Please find attached the Repair Order Docket. You can’t miss it; it’s titled Repair Order Docket.

I was informed ever so briefly that I would be contacted when the laptop arrived back at the Good Guys at Nunawading. So off home I went to continue my life of happily married bliss. Now this is interesting, what in fact transpired is that the Good Guys at Nunawading did not contact me at all.  I had to keep calling the store to find out what was going on with the laptop. The store number 03 9264 7464.  See I know it off by heart. But anyway, I digress ever so slightly.

One day in January 2010, yes January 2010, I must have arisen from my bed and been kissed on my backside by a very large Angel because when I called the Good Guys at Nunawading, guess what?  No, you’re wrong.  The laptop had not appeared back at the Good Guys but by the sheer of genius of the invention of wonderful technology, a note had appeared at the offices of the Good Guys at Nunawading from Acer. I assume it arrived via the electronic mail system thingy. You know you write stuff to someone, hit the, I mean click the send button and away it flies via the line of invisible technology and ether stuff.

The aforementioned note was not pleasant. It said apparently, that the machine could not be fixed under warranty as the screen fault was caused by physical abuse and therefore my fault. I assume that Acer is saying it was my fault as I am the only one that used the laptop. The laptop was brought in my wife’s name for me, because she thinks I’m kind of special. But once again, I digress ever so slightly. The good news was that Acer would fix the problem if I paid them $329.00. That’s almost half of what I paid for the laptop in the first place.  A bargain I thought. Why don’t I pay almost half the cost of something that I did not break to assist the cash flow of organisations like The Good Guys and Acer. I now understand the Acer pricing model. For things that have to be fixed, charge the customer half the cost of the original purchase that saves anyone at Acer having to do too much maths. And before all of that, lie about the warranty.

Upon hearing the news of my physical abuse I immediately went through a period of unbelievable incredible stress and strain and turned to alcohol to help me through this difficult period of my life. I spent time with a Psychologist, time with a Psychiatrist, and spent some time with two twin sisters who I don’t even know.  I blamed the alcohol for that, my wife blamed me, and subsequently told me that there would be no more nookie nookie for me. You know, no more ‘tripping the lights fantastic’. No more ‘humping the hubby’.  This disappointed me greatly. So much so that once again I spiralled downwards and out of control. And yes once again I had to spend time with a Psychologist, a Psychiatrist, and I even had to spend some more time with those two twin sisters, and one their cousins.

Now from my point of view, to be accused of physical abuse at my age, 52 going on 53 is indeed an accusation that I will wear like a badge of honour for the rest of my life. And this may not much longer if I spiral out of control again and end up back with the twin sisters and their cousin. After all, I’m not sure how big their family is! If you get my drift. By the way, the accusation that I physically abused an ACER laptop I deny. The laptop was only four weeks old. No one else used it. Only me! The laptop was not physically abused by me. To the best of my knowledge, I’ve never physically abused anyone or anything. Like, I won my last fight by 200 metres.

Upon perusal of the aforementioned form (that is attached) titled, The Good Guys Repair Order (you will know this form as Repair Order is written on it, at the top, in bold. It states down the bottom of this form a sentence that says, and I quote, ‘The customer acknowledges and agrees that a service fee is applicable if it is deemed that the fault is due to customers neglect or misuse. Please initial.’ End of quote.  Nowhere have I initial this form, nor has it been deemed that I am guilty of neglect or misuse.  In fact what Acer and the Good Guys have accused me of is physical abuse. Can you hear the drums Fernando?

So why don’t you guys from Acer and the Good Guys, admit the fault lies with one of you. Fix the damn laptop or replace it. You have more money than me.  I am prepared to sign a Statuary Declaration, take a lie detector test on national TV, (my TV works because it wasn’t made by ACER, nor brought from the Good Guys) to prove that I did not physically abused my laptop.

So come on folks, let’s stop making false accusations about your customers, and do the right by an old man. I don’t want to spiral out of control again. If you know what I mean!I also believe very strongly in the fact that I did not abuse my laptop as Acer and the Good Guys have  wrongly and unfairly accused me of doing.  As yet, they have provided no evidence to me that I have done this. Perhaps the technical (I use the term loosely) person from Acer that was assessing my poor laptop has made a genuine mistake.Anyway I have decided that other people should be informed as to what has happened to me.  Hopefully this little Aussie Battler taking on the corporate might of The Good Guys and Acer will gain a little bit of media or Government support and that way your treatment of me will be highlighted and that will cost you sales.  In the meantime I look forward to doing my business at HP, IBM, Macintosh, Harvey Norman etc.

And don’t expect me to give you the phone number of the twins.

Yours Sincerely,

PS.  I have also asked the Acer Help Desk to return my laptop back to me. I think that after all this physical abuse it just needs a good cuddle.
